4. Quotations and estimates
All quotations and estimates are given in good faith based on the information available at the time and are typically valid for 30 days unless stated otherwise.
A quotation may change if:
•       Site conditions differ from what was reasonably visible at the time of inspection.
•       Additional work is requested.
•       Access conditions change.
•       Hidden issues are discovered, including decay, decay-related instability, underground services, or obstructions.
Unless otherwise stated, quotations are based on the work specified only.
5. Acceptance of work
A quotation is accepted when you confirm in writing, by email, text message, or other agreed method, that you wish us to proceed.
Once accepted, the quotation and these Terms and Conditions form the agreement between you and HJHtreesurgery.
6. Access and site conditions
You are responsible for ensuring reasonable access to the site and for telling us about any restrictions, hazards, or special conditions before work begins.
This includes:
•       Locked gates or restricted access.
•       Parking restrictions.
•       Overhead cables.
•       Underground services.
•       Boundary issues.
•       Neighbouring property access requirements.
If we cannot access the site or carry out the work safely, we may charge a call-out fee or reasonable costs incurred.
7. Permissions and legal checks
It is your responsibility to check whether the work requires:
•       Tree Preservation Order consent.
•       Planning permission.
•       Permission from a landlord, managing agent, or freeholder.
•       Permission from a neighbour or third party.
•       Compliance with local authority or conservation area rules.
We may assist with applications or guidance, but unless agreed in writing, we are not responsible for obtaining permissions or checking private covenants.
8. Hidden obstructions and hazards
Where trees are to be felled, stumps removed, or soil disturbed, it is assumed that there are no hidden obstructions such as metal, concrete, rocks, foundations, services, or waste materials.
If hidden obstructions are discovered, we may pause the work, amend the price, or charge additional costs for extra labour, delays, damage, or equipment wear.
9. Standard of work
We aim to carry out work competently and in line with industry good practice, including British Standard 3998 where appropriate, unless otherwise agreed in writing.
Tree work is a living-system service, so results may vary depending on species, season, weather, previous pruning history, and site conditions.
10. Waste and arisings
Unless stated otherwise in the quotation, we will remove and dispose of agreed arisings from the site.
If you request to keep wood, logs, chippings, or timber, this must be agreed in advance. We are not responsible for the storage, handling, or future condition of any material left on site at your request.
11. Payment
Payment terms will be stated in the quotation or invoice.
Unless agreed otherwise:
•       Payment is due upon completion of the work being carried out.

•       We may require part payment or full payment in advance for larger jobs.
•       Late payments may result in interest and recovery costs, where permitted by law.
We reserve the right to withhold completion certificates, documentation, or further work until outstanding sums are paid.
12. Cancellations and rescheduling
If you need to cancel or reschedule, please give us as much notice as possible.
Where work is cancelled at short notice, we may charge for costs already incurred, including staffing, travel, waste disposal, or specialist equipment booked for the job.
If the work is cancelled after a cooling-off period has ended or after work has begun at your request, you may still be liable for costs already committed.
13. Weather and safety
Tree surgery is weather-dependent and safety-sensitive. We may delay, suspend, or postpone work if weather, ground conditions, or other factors make the work unsafe or impractical.
We will use reasonable judgement, but our decision on safety grounds is final for that visit.
14. Liability
We will take reasonable care when carrying out our work. However, to the extent permitted by law, we are not liable for:
•       Pre-existing defects or instability.
•       Natural movement, dieback, storm damage or failure occurring after work.
•       Damage arising from hidden defects or undisclosed hazards.
•       Consequential or indirect loss, including loss of profit or enjoyment.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
15. Complaints
If you are dissatisfied with any aspect of our service, please contact us as soon as possible and provide details of the issue.
We will review complaints fairly and aim to resolve them promptly.
16. Data protection
We will handle personal data in accordance with our Privacy Policy and applicable UK data protection law.
If you contact us, request a quotation, or use our services, we may store and use your details for admin, communication, invoicing, and service delivery.
17. Intellectual property
All text, images, branding, and other content on this website belong to HJHtreesurgery or are used with permission.
